Terms of Service

1. Purpose
These Terms of Service (ToS) set out how to access and use the caribBook platform, published by Baptiste RAILLARD — sole trader (SIREN 912 711 942).
caribBook is an online booking software (SaaS) intended for professional tourism accommodation providers (cottages, villas, vacation rentals) in the Caribbean.
2. Definitions
- "Platform": all services accessible via caribbook.com (API, dashboard, widget, booking pages)
- "Host": any professional registered on caribBook to manage bookings
- "Guest": any person making a booking through a host using caribBook
- "Service": all features made available by caribBook
3. Sign-up and account
Registering on caribBook is open to any professional with a legal tourism accommodation activity.
- The host commits to providing accurate and up-to-date information
- The password is personal and confidential; the host is responsible for the security of their account
- The email address must be verified to unlock all features
- caribBook reserves the right to suspend or delete any account in case of fraudulent use
4. Plans and pricing
caribBook offers several pricing plans:
- Free: 1 property, unlimited bookings, 5% commission on online payments
- Villa (€12/month): 1 property, unlimited bookings, 0% commission, iCal sync, custom domain, no caribBook branding
- Pro (€29/month): up to 5 properties, unlimited bookings, 0% commission, analytics and reports
- Agence (€59/month): unlimited properties, unlimited bookings, 0% commission, API access, priority support
Prices are in euros, VAT included. Annual billing is available with 2 months free (10 months paid instead of 12). caribBook reserves the right to change its prices with 30 days' notice. Existing subscriptions are not affected until renewal.
5. Payments and billing
- Payments are processed by Stripe. caribBook stores no card data.
- The subscription is monthly and auto-renews. The host may cancel anytime from the dashboard.
- If a payment fails, a 7-day grace period is granted before account suspension.
- caribBook charges a 5% commission on transactions processed via Stripe Connect for accounts on the Free plan, and 0% commission for paid plans, in addition to standard Stripe fees.
6. Host obligations
The host commits to:
- Publishing accurate and up-to-date information about their listings
- Complying with regulations applicable to their activity (registration, insurance, hygiene, tourist tax)
- Handling bookings in good faith and honouring commitments to guests
- Complying with GDPR for their guests' personal data
- Not using the platform for illicit purposes or in contravention of public morals
7. Role of caribBook
caribBook provides a technical tool for booking management. caribBook is not a party to the booking contracts between hosts and guests.
- caribBook is not responsible for content published by hosts
- caribBook is not responsible for the execution of stays or services
- caribBook does not intervene in disputes between hosts and guests
- caribBook commits to ensuring platform availability and security to a reasonable extent
8. Service availability
caribBook strives to maintain maximum platform availability (target 99.5%). Temporary interruptions may occur for maintenance. Scheduled maintenance is announced in advance via the dashboard.
Service status is available at status.caribbook.com.
9. Termination
- By the host: at any time from the dashboard. The subscription stays active until the end of the paid period. Data is kept for 30 days after closure, then deleted.
- By caribBook: in case of breach of these ToS, fraudulent use, or non-payment after the grace period. The host is notified by email before any suspension.
10. Intellectual property
The caribBook platform, its code, design and content are the exclusive property of Baptiste RAILLARD. The host retains ownership of their own content (photos, descriptions, text).
The host grants caribBook a non-exclusive licence to use their content solely for the purpose of displaying it on the platform.
11. Liability limitation
caribBook's liability is limited to the amount paid by the host over the past 12 months. caribBook cannot be held responsible for indirect damages (loss of revenue, loss of data not backed up by the host, reputational harm).

13. Changes to these ToS
caribBook reserves the right to amend these ToS. In case of substantial changes, hosts will be notified by email at least 15 days before they take effect. Continued use of the platform after that date constitutes acceptance of the new terms.
14. Applicable law and disputes
These ToS are governed by French law. In case of dispute, the parties commit to seeking an amicable solution. Failing that, the competent courts shall be those of the publisher's domicile.
Pursuant to article L.616-1 of the French Consumer Code, the host may use the consumer mediation service free of charge.
